Estate Planning Plans

California plans are prepared in association with California-licensed co-counsel.

Two plans. One clear path.

Frank Stucki, Esq., MBA will help you choose the plan that fits your family. Flat fees are quoted in writing before you hire Frank — no surprises.

Flat fees, quoted in writing. All fees are flat and quoted in writing before you engage Frank. You will know the full cost before you sign anything.

Documents are prepared under the law of the state where you live.

A solid foundation for most families.

Will-Based Estate Plan

A will-based plan is the right starting point for most families. It names who inherits your property, who raises your children, and who manages your finances and healthcare if you cannot.

Included documents

  • Last Will and Testament
  • Financial Power of Attorney
  • Healthcare Directive (Living Will)
  • HIPAA Release Authorization

Good for

  • Families with younger children who need guardianship designations
  • Individuals whose primary assets pass by beneficiary designation (retirement accounts, life insurance)
  • Those who want a complete, signed plan without the complexity of a trust
  • First-time estate planners

A will must go through probate before assets are distributed. For many families, the simplified probate process available in their state is manageable — Frank will explain whether it applies to your situation.

Avoid probate. Keep your plan private.

Trust-Based Estate Plan

A trust-based plan does everything a will-based plan does — and adds a revocable living trust that lets your assets pass to your family without going through probate court.

Included documents

  • Revocable Living Trust
  • Pour-Over Will
  • Financial Power of Attorney
  • Healthcare Directive (Living Will)
  • HIPAA Release Authorization
  • Certificate of Trust
  • Deed transferring your home into the trust

Good for

  • Homeowners who want to avoid probate on their real property
  • Families who value privacy (trusts do not become public record)
  • Those with property in multiple states
  • Anyone who wants maximum control over how and when assets are distributed

A trust only controls assets that are transferred into it. Frank will walk you through funding your trust — including the deed for your home — so nothing is left out.

Not sure which plan is right for you?

Most families do not need to decide before talking to Frank. The intake form asks a few questions about your family and assets, and Frank will recommend the right plan during your consultation — at no charge.
